The folly of appointing the ‘wrong’ person to be an attorney or executor has been exemplified recently by two cases in which an attorney and an executor were both convicted of misappropriating assets.
In the first instance, the attorney of a Yorkshire woman was jailed after admitting the theft of more than £200,000 by misusing his power of attorney.
In the second instance, a Kent man who acted as the executor of his grandfather’s estate was convicted of taking more than £50,000 from the estate assets after he failed to reveal the existence of a bank account to the beneficiaries.
