Phil Mulryne acted for Mr P, the Claimant, to pursue a claim for personal injury damages following an accident at work.
Tripped Over Discarded Pallett
The Claimant was employed as an agency worker and was collecting stock when he tripped over a pallet which had been discarded in an aisle.
The claim was submitted to the employer’s insurers who accepted responsibility.
Injury To Left Arm
As a result of the fall the Claimant sustained an injury to his left arm, in particular his shoulder and elbow. The Claimant underwent sessions of physiotherapy which improved his symptoms.
At around two years following the accident the Claimant did not experience any ongoing pain in his elbow, just very occasional stiffness and tightness which didn’t affect him on a day-to-day basis.
As a consequence of post-accident absences from work the Claimant incurred a small amount of loss of earnings. He also had to have some help with domestic tasks from his mother.
£5,500 Compensation Awarded
The insurance company put forward an offer of £5,000 for personal injury damages. This was rejected and subsequently increased to the sum of £5,500.
