£3k Awarded Following trip on Defective Safety Matting

Phil Mulryne acted for Miss S, the Claimant, to pursue a personal injury claim.

Miss S is a school child and suffered an accident when she tripped due to defective safety matting which was split, causing her to hit her face on a metal climbing frame.

The Claimant’s mouth bled profusely and in a lot of pain so her mother took her to an emergency dentist. On examination, her two front teeth had been forced backwards. They were manipulated into the correct position. She was prescribed anti-biotics. There was a concern that there was a possible risk of tooth loss and/or permanent damage to her teeth.

She was unable to eat solid food for a number of weeks and had difficulty with sleeping.

Her mother took her for precautionary check-up appointments for the first 3 months following the accident.

A medical report was obtained to support the claim, and the medical expert was concerned that there may have been a knock on effect to the development of the Claimant’s adult teeth so it was recommended that further medical evidence be deferred until the Claimant’s adult teeth arrived.

Thankfully, there were no other issues with the Claimant’s teeth and the claim could be settled on the basis of a fully recovery.

It was felt that the claim was worth in the region of £2,500.00 to £3,000.00 but a negotiated settlement was reached with the Defendants at £3,000.00 with the above sum approved by a Judge at a Court Hearing. Court approval was required; bearing in mind the Claimant is under the age of 18 with the settlement award being invested in the Claimant’s child trust account.
