As some of you may know, the Divorce, Dissolution and Separation Act gained Royal assent on 26th June 2020, meaning that the new no fault divorce law can be implemented shortly. It is due to come into force in Autumn 2021 and this means that parties will be able to divorce without having to blame the other when seeking a divorce.

Many ask whether or not this will make divorce easier and therefore more attractive to people. That may be the case, but it is hoped that if people do want to divorce and it can go through far more amicably (especially when children are involved) then this should be encouraged. In addition, it should mean that more focus can be spent on resolving the finances in an amicable fashion and hopefully making matters more cost effective for the family involved.

As it stands, parties have to rely on either adultery, unreasonable behaviour or separation for two or five years to be able to seek a divorce, so this is a significant step forward.
