Falling Plaster Damages Claimant’s Nose
Briefly as regards to the circumstances of the accident the Claimant was at the third party premises when a piece of plaster fell from the ceiling striking her face, in particular, the bridge of her nose.
Dizziness And Shock
The Claimant suffered a 1cm cut to the bridge of her nose and immediately afterwards felt dizzy and in shock.
The Claimant attended hospital and was told that she could not have an x-ray as her nose was too badly swollen. She was given general advice and advised to return in the event she suffered further symptoms.
Nose Swelling Became Extensive Along With Fever And Headaches
The swelling became more pronounced and she found that she was unable to open her eyes properly. She also experienced a fever and an intense headache.
The symptoms resolved after a few weeks but she still experienced an area of sensitivity on the bridge of her nose with some scarring.
Permanent Scarring Suffered
The scarring was fairly minor but the medical practitioners indicated that this would be permanent.
Following the accident, her husband took 2 weeks off work to care for the Claimant and also take over her share of the household duties.
Liability Accepted By Insurance Company
When the claim was submitted to the owners of the premises, responsibility was accepted by the insurance company.
The insurance company put forward an offer of £3,040.00 for personal injury damages and £50.00 for care and assistance provided by the Claimant’s husband.
Initial Damages Rejected With Court Hearing Awarding £5,150
This offer was rejected and the matter proceeded to a Court hearing with the Claimant being awarded £5,000.00 for her injury and £150.00 for care and assistance provided by her husband.
