Jodie Doran, Solicitor at Ward & Rider Limited, acted for a client who suffered a personal injury in an accident at work. The client was employed as a warehouse operative and at the time of the accident was going about his usual duties. Repairs to his machine had been carried out prior to his shift and unfortunately the machine had not been repaired in the way that it should have been. A hole had been left in the floor following the repair work and it had not been filled as it should have been. A mat had simply been put over the hole so that the client was not able to identify the hazard.
Liability for the accident was admitted immediately by the client’s employer. This therefore meant we had to carefully assess the client’s injuries. Medical evidence was obtained from a Consultant Orthopaedic Surgeon who agreed that the client suffered injury to his ankle and shoulder as a consequence of the accident. Fortunately the ankle made a good recovery but the shoulder caused ongoing problems. The medical expert felt that the shoulder injury would reach a recovery within 5 years of the accident occurring.
In addition to the injury, the client claimed financial losses for travel and medication expenses incurred as a consequence of the accident. There was also a claim for lost earnings because of the time the client had off work as a consequence of the accident. The Defendant’s Insurers would not agree an appropriate figure to settle this claim and so we had no choice but to issue Court proceedings. Eventually, the client was compensated in the sum of £15,000.
