Our client tripped and fell over a barrier at work and his injury was caused due to the unsafe nature in which he was expected to perform his job. He sustained injury to his knee as a consequence of his fall.
Our client suffered significant problems with his knee for some years prior to the accident, and he was in some pain with his knee at the time of his accident. As a consequence of the accident, the pain to his knee increased significantly for a short period of time, before returning to how it felt before the accident.
Liability was admitted early on in the claim but there was fierce opposition from the defendant as to the value of the claim. The defendant was of the opinion that this claim was worth a lot less than what Ward & Rider was prepared to accept was a good settlement for our client. The defendant was unwilling to agree the value of the injury as well as the value of the financial losses incurred by our client as a consequence of his accident. Therefore this meant both Ward & Rider and the defendant instructed their own medical experts and the matter was highly contested throughout.
After negotiation, our client received in the region of £27,500 in full and final settlement of his claim.
