Barrington Atkins acted for a client from Coventry who was hit by a vehicle whilst on his bicycle The claimant had stopped at a busy roundabout on London Road and was at the front of the traffic queue waiting to safely proceed with his journey when, suddenly, a third party driver collided into the rear of the claimant’s bicycle. The third party vehicle hit the claimant’s back tyre causing the claimant to fall straight over the handlebars, and fall heavily onto the ground. The client suffered neck and back injuries.
The third party insurers denied liability for the accident as they suggested the claimant was weaving between traffic and should have used the nearby cycle lane, which would have avoided the accident.
Barrington fought the issues on liability and the matter was ultimately issued at Court. Liability was admitted two years after the accident occurred and Barrington successfully secured £6,000 compensation for his client.
