Successful Compensation Claim Following Slip in a Night...
Ward & Rider Solicitors, acted for a Mrs T on a no win no fee basis in order to secure personal injury compensation of £10,000.
Mrs T is a Nurse living in Northampton. She had gone to a nightclub with a group of friends. Mrs T was dancing on the dance floor when suddenly she sliped and fell sustaining a personal injury. It had been raining heavily that evening and people had been walking water into the nightclub and onto the dance floor. The matter was further compounded by the lack of matting at the relevant exits so as to reduce the extent of water being brought into the nightclub particularly onto the dance floor.
Liability was initially denied by the nightclub insurer but we traced a number of witnesses and were also able to produce photographic evidence showing that after the accident the nightclub put in place matting so as to prevent this type of accident from reoccurring.
We stuck to our argument and upon the production of the witness statements and the photographic evidence that the area on the dance-floor was wet and was a slipping hazard, they accepted liability and agreed to offer Mrs T peronal injury compensation.
Mrs T suffered a fracture to the base of her left great toe which left her unable to work for a two week period and was unable to wear high heeled shoes with comfort for very long. She was also unable to stand for prolonged periods of time.
There was a small risk that Mrs T may have required further surgery in the future, but the outlook was good.
Her personal injuries did not prevent Mrs T from carrying out her work as a Nurse but she had to modify her footwear. There was a small interference with her social activities but nothing too drastic.
Following a series of offers and counter offers the insurers for the nightclub paid Mrs T £10,000 for her personal injury claim. They also paid her legal costs.
