Personal injury Claim Settlement for Security Guard

Jason Claridge, Personal Injury lawyer at Ward & Rider Solicitors, acted for Mr G* from South Warwickshire on a no win no fee basis.  Our client was a Security Guard working nights.  On his way to work he had been held up by a queue of traffic.  He was travelling down a rural lane to a large site which housed luxury cars for which he was a Security Guard.  His vehicle was hit with some force by the vehicle behind which resulted in a personal injury.

Our client's vehicle was written off.  He also suffered soft tissue injury to his neck, commonly referred to as a whiplash injury.  Details were exchanged and he went to the local Accident & Emergency Department.  There he received some treatment.  He had to take some time off work due to his injuries because he had to be physically fit enough to do his job.  He was paid his basic salary but lost any entitlement to overtime. We acted on behalf of MR G and started to file a compensation claim 

We obtained the Police Accident Report.  This gave us the details of the other driver and their insurer.  We contacted them both repeatedly but did not receive a response from them.  We therefore obtained a medical report on our client's injuries and produced a Schedule of Financial Losses.  This included the cost of his vehicle, as he was only insured third party, fire and theft.  Thankfully his previous physical condition stood him in good stead and he made a remarkably quick recovery from what was a serious impact as a consequence of this accident.

Still the insurers did not make any offers, and as a result we issued Court proceedings.  This resulted in the insurers realising that they had to make our client an offer of compensation in respect of his injuries and financial losses.

As usual, there then followed a period of negotiation.  Ultimately our client was happy with an offer of £4,500.00, with the bulk of that being for his injuries and financial losses as the vehicle that he was driving was worth around £500.00 prior to this accident.

Once the cheque had been received we sent this to our client.  The other side's insurers also paid for our client's legal costs.
