Compensation of £48,000 for Successful RTA Claim
Phil Mulryne acted for Mrs R from Coventry on a no win no fee basis for the accident claim.
Mrs R was on a shopping trip and was waiting on the footpath for a bus.
A van which was on the footpath reversed into the Claimant knocking her to the ground and causing significant injuries that warranted a compensation claim. The van driver was charged with criminal proceedings and subsequently liability was admitted by the van driver's insurance company.
The Claimant sustained multiple injuries. She suffered a fracture to the right wrist together with a soft tissue injury to the lower back. As a result of being knocked to the floor the Claimant sustained a fracture to the right jaw and the impact was so significant that this broke the bottom set of the Claimant’s dentures which needed replacing. The Claimant also sustained some temporary hearing loss in ears due to bleeding.
The Claimant's injuries improved but there was a risk of further treatment and surgery to the wrist which the Claimant wanted to avoid due to her age. It was anticipated the Claimant would require further treatment in relation to back injury although this was due to some extent to a worsening of a pre-existing condition.
The Claimant was incapacitated as a result of the injuries and relied on her husband and daughter to carry out domestic duties. As a result she was unable to do any ironing and only after a while very light housework. Her husband had to take over the shopping duties because she was unable to carry shopping or heavy bags.
It was anticipated that this assistance would continue in the future.
Settlement was agreed in the global sum of £48,000.00. This represented payment for personal injuries, some expenses for damaged items and an award for care provided by family members to include the future care and assistance.
