£3,500.00 compensation following a trip at work
Maria Dobson, Personal Injury Lawyer at Ward & Rider Solicitors acted for Mrs J* on a no win no fee basis.
The Claimant was employed as a cook at a Nursing Home. On the day of the accident at work, the Claimant was walking from the dining room into the kitchen when, without warning, she tripped over a mat which was situated in the doorway. As a result of the accident, the Claimant sustained soft tissue bruising to her right leg, left arm, right hand along with ligament damage to her left wrist.
Initial instructions were received by Maria Dobson and investigations were entered into liability. Liability was initially denied by the Defendant's solicitors.
In support of the Claimant's compensation claims, witness evidence was obtained from other employees of the Nursing Home to prove that the mat was dangerous and that following the Claimant's accident, it had been removed.
After much procrastination on the part of the Defendant's solicitors, they eventually agreed to deal with the matter without an admission of liability.
The Claimant's medical records were then obtained along with a medical report from an Orthopaedic Consultant. Investigations were made into the Claimant’s free claim for special damages and a Schedule of Loss was prepared which claimed loss of earnings, travelling expenses, medical expenses, domestic care and assistance along with reclaiming the cost of the hairdresser as the Claimant was unable to do her own hair given the injuries sustained.
Following negotiations and after some discussion with the Defendant’s solicitors, Maria Dobson was able to agree a figure for compensation of £3,500.00. Mrs. J also had her legal costs paid by her employer's solicitors.
